By accessing or using our website https://chastitytek.com (the "Site"), you agree to comply with and be bound by the following terms and conditions (the "Terms of Service" or "Agreement"). Please read these Terms of Service carefully as they contain important information about your legal rights, remedies, and obligations.

1. Acceptance of Terms

By accessing or using our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. This Agreement applies to all visitors, users, and others who access the Site ("Users").

We reserve the right to terminate or suspend your access to the Site for any violation of these Terms.

5. Purchases

Orders for the Veru One, including pre-orders, are governed by our Terms of Sale, which explain how orders are accepted, when your card is charged, ship windows and delays, cancellation, and your legal rights. Our Shipping Policy, Returns and Refunds Policy, Limited Warranty and Legal Restrictions also apply to purchases. If these Terms of Service and the Terms of Sale conflict about a purchase, the Terms of Sale apply.

6. Content and Intellectual Property

All content, including but not limited to text, graphics, logos, images, audio clips, and software available on the Site (the "Content") is the property of ChastityTek or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, and non-transferable license to access and use the Site and the Content for your personal, non-commercial use. You may not:

  • Reproduce, distribute, or modify the Content without our prior written consent.
  • Use any Content for commercial purposes without express authorization from us.

7. Third-Party Links

Our Site may contain links to third-party websites or services that are not owned or controlled by ChastityTek. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. 8. Disclaimers

The Site and all its Content are provided on an "as-is" and "as-available" basis without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not guarantee that the Site will be error-free, secure, or available at all times, nor that any defects will be corrected. This section concerns the Site and its Content; products you buy from us are covered by our Terms of Sale and Limited Warranty.

Product Disclaimer (Chastity Devices): ChastityTek's products, including but not limited to chastity devices, are designed and intended for adult use only. They are not medical devices and should not be used as a substitute for professional medical advice or treatment. Always consult a medical professional before using any device that may affect your health or well-being. You use our products at your own discretion and are responsible for following their instructions and warnings. We are not liable for injury, damage or loss to the extent it is caused by misuse, by use that goes against the instructions or warnings (for example, wearing a device for longer than the instructions allow, or continuing to wear it after pain, numbness, swelling or skin changes), or by modifying a product. If you live in the United States, to the fullest extent permitted by law, this applies to any injury, damage or loss caused by any of those things.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall ChastityTek, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill resulting from:

  • Your access to or use of the Site.
  • Any unauthorized access to or use of our servers and/or any personal information stored on them.
  • Any interruption or cessation of transmission to or from the Site.
  • Any bugs, viruses, or other harmful code transmitted through the Site.
  • Your use of any content posted, emailed, transmitted, or otherwise made available through the Site.

In no event shall our total liability to you for any claims arising out of or relating to your use of the Site exceed the amount paid by you, if any, for accessing the Site. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including your rights as a consumer.

If you are a consumer in the United Kingdom, this section 9 does not apply to you, except that we are not liable for losses that were not reasonably foreseeable or for business losses such as loss of profit or business opportunity, because the Site is provided for private use. If you are a consumer in the European Union or Australia, this section 9 does not apply to you. Nothing in this section 9 limits your rights under data protection law.

10. Indemnification

Unless you are a consumer in the United Kingdom, the European Union or Australia, to the extent permitted by law you agree to indemnify ChastityTek, its affiliates, officers, employees, and agents against claims brought by third parties, and the resulting liabilities, damages, losses and reasonable expenses (including reasonable attorney's fees), to the extent they arise from:

  • Your misuse of the Site or your use of it in violation of law.
  • Your violation of any part of these Terms.
  • Your violation of any third-party rights, including but not limited to any intellectual property, privacy, or other rights.

This section does not apply to claims you bring against us, or to the extent a claim arises from our own negligence or misconduct. Consumers in the United Kingdom, the European Union and Australia remain responsible under the law where they live for loss they cause by breaking these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute covered by section 13 of our Terms of Sale is resolved only as that section provides; any other dispute will be brought in the state or federal courts located in Clark County, Nevada. Nothing in this section deprives you of the protection of mandatory consumer-protection laws of the state or country where you live that cannot be waived by agreement, and this section does not apply to consumers in Quebec. If you are a consumer in the United Kingdom or the European Union, you may also bring proceedings in the courts of the country (or, in the United Kingdom, the part of the United Kingdom) where you live, and we may bring proceedings against you only in those courts. If you are a consumer in Canada or Australia, you may also bring proceedings in the courts of the province, state or territory where you live.

12. Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to the Site without prior notice for any reason, including but not limited to your violation of these Terms of Service.

Upon termination, all provisions of the Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.

14. Entire Agreement

These Terms of Service, along with our Privacy Policy and, for purchases, our Terms of Sale, constitute the entire agreement between you and ChastityTek regarding your use of the Site and supersede any prior agreements or understandings, whether written or oral.

16. Crowdfunding Contributions

a. Crowdfunding Campaigns: From time to time, ChastityTek may offer products or services through crowdfunding platforms (e.g., Indiegogo). By participating in any such campaign, you acknowledge and agree that:

  • Your contribution is a pledge to support the development and production of the product(s) described in the campaign, not a purchase of a finalized product.
  • All timelines, product features, and specifications provided during the crowdfunding campaign are estimates and are subject to change.
  • ChastityTek makes no guarantees regarding the final design, functionality, or delivery date of the product(s). This does not affect the consumer guarantees under the Australian Consumer Law, or the statutory rights of consumers in the United Kingdom, the European Union and Canada, for a device you receive.

b. Refunds for Crowdfunding Contributions: Unless otherwise stated in writing by ChastityTek, contributions made through a crowdfunding platform are not refundable, except where the platform's terms, the campaign's terms or the law require a refund. You understand that delays, modifications, or unforeseen challenges may arise, and by pledging, you accept these risks. This does not affect your rights if a device you receive is faulty or not as described, or any right to cancel or to a refund that the law gives consumers in the United Kingdom, the European Union, Canada or Australia. For backers in Australia: our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

c. Website Purchases: Orders placed directly on the Site are governed by our Terms of Sale and Returns and Refunds Policy, not by this section. Those policies do not apply retroactively to crowdfunding contributions.

By participating in our crowdfunding campaigns, you acknowledge these conditions. To the fullest extent permitted by law, ChastityTek is not liable for losses or missed expectations caused by the delays, modifications or challenges described above, except that this limitation does not apply to consumers in the United Kingdom, the European Union, Canada or Australia.
